How does a videoconference hearing take place?
On March 16, 2020, the Council of Judges of Ukraine adressed its recommendations to courts of all instances regarding the provision of a special regime for their work between March 16 and April 3, 2020. The list of recommendations included, in particular, clarifying to citizens the possibility of postponing proceedings due to the quarantine and the possibility to hear the cases through videoconferencing. At the same time, it was noted that “when deciding on the possibility of hearing cases in videoconference mode, it should be taken into account that such mode of work of the court does not fully protect against the spread of the disease, since it still requires the appearance of citizens in several courts providing a court hearing in this mode.” Having experience in videoconferencing as a lawyer, I must note that the current procedure for such hearings does not assist the actual enforcement of quarantine restrictive measures.
