ANK Law Office protected Owners interests in the Supreme Court
ANK Law Office successfully represented interests of shipowners from Singapore BW DRY CARGO in the case against ecological inspectorate, which was recently examined by the Supreme Court. According to the Resolution on the case 420/4129/19 signed on 19th of October 2020, the Supreme Court satisfied the second appeal claim of the Shipowners and cancelled decisions of the first and appeal instances with sending the case for new examination to the first instance court. The Shipowners were forced to commence the court proceeding against ecologists because of detention of their vessel in Yuzhny port in July 2018, which was initiated by ecologists within “traditional” control of segregated ballast along with issuing the letter of claim (ukr. “pretenzia”) for alleged pollution of the port’s water area during deballasting operations. The courts of first and appeal instances rejected Owners claim. However, the Supreme Court concluded that Owners rights and interests were violated by ecologists and cancelled both judgements. The particular interest in this case should be given to the instructions of the Supreme Court addressed to the lower courts in the Resolution. It should be noted that this is the first “maritime” case against ecologists, which was examined by the highest court instance in Ukraine.
