ANK protected NORDEN in the court
Attorneys of ANK Law Office successfully protected the interests of NORDEN (Denmark) in the court case with the shipping agent on unjustified enrichment. One of the biggest shipowners in Denmark submitted a claim to the commercial court in August 2020 with a court claim against one of the local shipping agent, whereby asked to repay USD 81k as funds received without legal grounds (unjustified enrichment). The Claimant reported that aforesaid amount was overpaid to the shipping agent as a result of increased value of the towing services by the shipping agent. Due to difficulty of the case the proceeding in three instances took 1,5 years. Finally, on 8th of February 2022 the Supreme Court has confirmed the judgement of the appeal court, which satisfied the claim in full and ordered the shipping agent to return to the Danish shipowner USD 81k as funds received without legal grounds (unjustified enrichment) and compensated the legal fees of the Claimant.
NORDEN was established in 1871 and is one of the leading shipowners in Denmark operating tank and bulk fleet of about 500 vessels. As a shipowner, NORDEN is very active in the Black Sea regions having special focus in Ukraine.
