ANK defended the client’s interests in a case involving a violation of customs regulations

ANK team successfully defended the interests of a Ukrainian importer in a case involving customs violations, which was heard by the courts of first instance and appellate courts. This Ukrainian company specializes in wholesale trade and is the official distributor of EPG Industries- a worldwide manufacturer of innovative products for the protection, convenient transportation, and storage of various cargoes. In November 2025, customs authorities issued several reports of customs violations against the director of a Ukrainian importer, which were subsequently referred to court. ANK attorneys team developed a defense strategy for the client, convinced the court to consolidate all the reports into a single proceeding, worked to form a body of evidence confirming that the client’s actions did not constitute an administrative offense, prepared and submitted written explanations to the court on behalf of the client.

As a result of the efforts of ANK’s attorneys, the court of first instance dismissed the case due to the absence of any elements of an offense in the actions of the company’s director. Customs appealed this ruling to the appellate court; however, the court of appeal dismissed the appeal, agreeing with the defense’s arguments. The appellate court’s ruling took legal effect on the date it was announced and is not subject to further appeal.

ANK team in this case was represented by Artem Volkov, Head of the Maritime Law Practice, Attorney-at-Law and Ihor Danyliuk, Attorney-at-Law, under the general supervision of Oleksandr Kyfak, Managing Partner and Attorney-at-Law.
