Work on holidays during martial law
In connection with the approach of the spring holidays, questions arise regarding work on the days of such holidays during martial law.
So, the next days off should have been April 25th (postponing Easter from April 24th), May 2nd (postponing Labor Day from May 1st) and May 9th (Victory Day).
However, according to Art. 6 of the Law of Ukraine “On the organization of labor relations under martial law” No. 2136-IX dated March 15, 2022, for the period of martial law, certain norms of the Labor Code of Ukraine are not applied in relation to holidays and non-working days and the duration of work on the eve of holidays, non-working days and days off.
Thus,
Monday April 25th 2022,
Monday May 2nd 2022
Monday May 9th 2022 – are normal working days.
Work on such days is paid in the usual manner, the restrictions established by Article 53, Part 1 of Article 65, Parts 3-5 of Article 67 and Articles 71-73 of the Labor Code of Ukraine do not apply. Namely, the day off is not postponed to the next day after the holiday, work on these days is not compensated (other day off or double payment is not provided), working hours on the eve of the holidays are not reduced – work on these days is considered a normal working day.
