Register of damaged and destroyed property begins work
At the end of last week, the Ministry of Infrastructure, together with the Ministry of Digital Development, presented the start of the work of the State Register of Property Damaged and Destroyed as a result of hostilities, terrorist acts, sabotage caused by the military aggression of the Russian Federation (hereinafter referred to as the Register).
The creation and functioning of the Register is provided for by the Procedure for submitting an information message about damaged and destroyed real estate as a result of hostilities, terrorist acts, sabotage caused by the military aggression of the Russian Federation, approved by the Resolution of the Cabinet of Ministers No. 380 of March 26, 2022 “On the collection, processing and accounting of information on damaged and destroyed real estate as a result of hostilities, terrorist acts, sabotage caused by the military aggression of the Russian Federation” (with subsequent amendments and additions).
The Register is a single database for collecting, accumulating, recording, processing, storing and protecting information about all residential, transport and social infrastructure affected by the military aggression of the Russian Federation against Ukraine.
It should be noted that initially the above-mentioned Procedure applied exclusively to individuals – owners of apartments, other residential premises in a building, private residential, garden or country houses. Subsequently, the functionality was expanded to collect information on damaged or destroyed real estate of legal entities (both in ownership and in operational management) and non-residential facilities.
Register includes information about:
– damaged and destroyed real estate;
– persons whose real estate is damaged or destroyed;
– damage and losses caused as a result of damage to such property.
A person may submit an information notice to enter relevant information about such property in the Register through:
– the Unified State Web Portal of Electronic Services (Diya Portal) or through the Diya mobile application;
– a notary;
– a Center for the provision of administrative services.
The information entered into the Register is open and publicly available (except for personal data). No deadlines have been set yet for information on damage or destruction of real estate to be entered into the Register.
It should be noted that at this stage the Register is only a tool for collecting and systematizing information about damaged and destroyed property. However, in the future, information from the Register can potentially be used for the purposes of calculating and paying compensation for damage and destruction of real estate objects, after an appropriate legal mechanism is introduced, which does not yet exist.
Considering all of the above, if there is damage or destruction of the company’s property due to hostilities, in addition to our previous recommendations, we also recommend submitting an information message to the Register in order to fix the facts of such damage or destruction.
